Croatia, CBD, and Cannabis: What You Need to Know


CBD is one of the cannabinoids found in the hemp plant, yet it is often confused with THC and cannabis in general. However, these are fundamentally different substances, particularly in terms of their health effects. Some European countries make a clear distinction between CBD and cannabis in their legislation, while others prohibit anything derived from the hemp plant, lumping CBD and cannabis together.

CBD and cannabis: Is it legal to use them in Croatia?


As for CBD products, their use is indeed legal in Croatia. As in most other European countries, their legality is contingent on the THC content not exceeding 0.2 %. 


The best-selling CBD products are oftenCBD oils or extracts, which allow you to adjust the CBD dosage in any base product.


However, when it comes to cannabis, Croatian law is more complex. Previously, the law was very strict on this issue: all forms of cannabis were illegal—including its cultivation, sale, and use. The fact that you were in possession of even a tiny amount of cannabis, or that your use was strictly for personal purposes, had no bearing on the penalties you faced. 


The average range of fines is therefore between €600 and €1,300.


These days, it’s fair to say that Croatia has relaxed its laws on this issue. Possession and use of cannabis have thus been reclassified from a crime to a minor offense. Legal proceedings have therefore been replaced by simple fines, and cannabis could even be legalized in the coming years.


What about the cultivation and sale of cannabis in Croatia?


The cultivation of cannabis in Croatia has been the subject of much debate for several years. From a legal standpoint, any form of cannabis cultivation is strictly prohibited on Croatian territory. The sale of cannabis is no better off, as it is punishable by up to 3 years in prison. In practice, however, most cases of cannabis possession and use are punished with a simple fine.


However, this refers to the legal framework specific to cannabis. CBD is subject to different—and, in this case, much broader—restrictions. In Croatia, the sale, purchase, and consumption of CBD are completely legal. As a result, you face neither fines nor legal action if you’re a cannabidiol enthusiast. Keep in mind, however, that CBD must come from industrial hemp and contain no more than 0.2% THC.


The new bill that could revolutionize everything


Croatian cannabis legislation may soon undergo a major overhaul. A bill is in the works that aims to legalize cannabis—completely.

What should we expect? The main objectives of this bill are:

  • to allow personal cultivation of cannabis at home, up to nine plants per person,
  • to develop a distribution and sales network that includes both public and private sectors,
  • and, finally, to create a concrete development plan specifically for the hemp industry.

This bold bill was introduced by Mirela Holy, former Minister of Ecology and a member of the Sustainable Development Party. She has been trying for many years to bring the issue of cannabis legalization to the table, which has inevitably sparked a wide range of reactions within the Croatian Parliament. She herself has proposed that all Croatian citizens be allowed to grow cannabis at home, up to nine plants per person. Her motivations include combating the illegal trafficking of cannabis, countering dangerous and toxic products already circulating on the black market, and boosting the country’s appeal to tourists.


The Status of Medical Cannabis in Croatia


It can be said that cannabis comes in various “forms,” and medical—or therapeuticcannabis is one of them.

More and more European countries are enacting different laws for recreational cannabis and medical cannabis. Medical cannabis has been legal in Croatia for over five years, provided it is prescribed by a doctor in the patient’s name. Medical cannabis is reportedly gaining popularity among an increasing number of athletes, particularly because of its potential benefits for endurance and muscle recovery.


Croatia is thus seen as a progressive country on the issue of medical cannabis, at least in Europe. It has based its stance on various scientific studies attesting to the natural properties of cannabinoids, which are believed to reduce stress and anxiety, relieve chronic pain, and improve metabolism. A key factor in the legalization of medical cannabis has been its positive impact on certain serious conditions, such as epilepsy and Alzheimer’s disease.
